Acceptance of Terms

By accessing and using HireSpark at usehirespark.com, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use this service. If you have questions, visit our Support Center.

Service Description

HireSpark is a web-based resume intelligence platform that provides:

• AI-powered resume creation and optimization tools
• Professional resume templates and a full resume editor
• ATS (Applicant Tracking System) compatibility analysis and scoring
• AI-generated cover letter creation and tailoring
• Export functionality for PDF and DOCX formats (one-time purchase)
• Job listings aggregated from third-party sources
• Free resume tools including ATS score checker, keyword scanner, and ATS checker

User Accounts

Many features are available without an account. To save work, purchase downloads, or access credits, you may create an account via Replit OAuth. By creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use at hello@usehirespark.com
• Be responsible for all activities under your account

Acceptable Use

You agree not to use the service to:

• Upload false, misleading, or fraudulent information
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute spam, malware, or harmful content
• Attempt to gain unauthorized access to our systems or other users' data
• Resell or sublicense the service without express written permission
• Reverse engineer, decompile, or scrape the platform

Payment Terms

Pricing

HireSpark operates on a freemium, pay-per-download model:

• Building, editing, and previewing resumes is completely free — no account required
• Resume download (PDF + DOCX): $2.99 one-time
• AI Review + download: $4.99 one-time
• Build + Review Bundle: $5.99 one-time
• Cover Letter download (PDF + DOCX): $2.99 one-time
• Career Launch Kit: $14.99 one-time (includes all of the above plus 3 tailored cover letters)
• There are no subscriptions, free trials that auto-convert, or recurring charges of any kind

Billing and Refunds

All payments are processed securely through Stripe. Because you can preview your resume in full before paying, downloads are non-refundable once processed. If you experience a technical issue that prevents delivery of your purchased files, email hello@usehirespark.com and we will resolve it promptly.

Credits

Purchases may add credits to your account (e.g., Career Launch Kit credits). Credits are non-transferable, non-refundable, and do not expire. Credits can only be used for the specific services they were purchased for.

AI-Generated Content Disclaimer

HireSpark uses OpenAI's GPT-4o to power resume analysis, bullet point rewrites, and cover letter generation. You acknowledge and agree that:

• AI-generated content is provided "as is" and may contain inaccuracies, errors, or suggestions that are not appropriate for your specific situation.
• You are solely responsible for reviewing, editing, and verifying all AI-generated content before using it in any job application or professional document.
• HireSpark does not warrant that AI-generated content will be factually accurate, complete, or suitable for any particular purpose.
• You must not submit AI-generated content that is false or misleading to prospective employers. Fabricating experience, qualifications, or achievements is prohibited.
• HireSpark is not liable for any outcome resulting from the use of AI-generated content, including decisions made by employers or recruiters.

Job Listings — Third-Party Disclaimer

HireSpark's job board aggregates listings from third-party sources and APIs. We do not verify the accuracy, completeness, or legitimacy of any individual job listing. You acknowledge that:

• Job listings are provided for informational purposes only and may be outdated, inaccurate, or no longer available.
• HireSpark is not affiliated with, endorsed by, or responsible for the hiring decisions of any employer listed.
• You interact with third-party job postings at your own risk. HireSpark is not liable for any loss or damage resulting from applying to or communicating with any employer found through our job board.
• If you encounter a fraudulent, misleading, or inappropriate listing, please report it to hello@usehirespark.com.

No Employment Guarantee

HireSpark provides resume and cover letter tools designed to improve the quality and ATS-compatibility of your job application materials. However:

• HireSpark makes no guarantee, express or implied, that using our tools will result in job interviews, offers, or employment.
• Hiring decisions are made by employers based on many factors outside our control, including market conditions, competition, employer preferences, and your qualifications.
• ATS scores and analysis are estimates based on common ATS behavior. Individual ATS systems vary and results may differ.
• HireSpark is not liable for any failure to secure employment, loss of income, or other damages related to job search outcomes.

Affiliate Program

HireSpark operates an affiliate referral program that allows approved partners to earn commissions by referring new paying customers. By participating in the affiliate program, you agree to:

• Promote HireSpark only through honest, accurate representations of the product and pricing.
• Disclose your affiliate relationship in accordance with applicable advertising laws (including FTC guidelines in the US).
• Not engage in spam, misleading advertising, incentivized clicks, or cookie stuffing.
• Accept that commission eligibility requires a valid conversion (purchase) within 90 days of the referred click.
• Accept that HireSpark may modify or terminate the affiliate program at any time with reasonable notice.

Affiliate commissions are calculated on net purchase amounts (excluding taxes and refunds) and paid on a schedule communicated in the affiliate dashboard. HireSpark reserves the right to withhold or reverse commissions for fraudulent or invalid referrals.

Intellectual Property

Your Content

You retain ownership of the content you create using our service (your resume text, work history, personal details). By using our service, you grant us a limited license to store, process, and transmit your content solely to provide the service to you.

Our Service

HireSpark, including its templates, designs, software, and underlying technology, is protected by intellectual property laws and remains our exclusive property. You may not copy, distribute, or create derivative works based on our platform without express written permission.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which governs your use of the service and details how we collect, use, and protect your information, including AI content processing, affiliate tracking, survey data, and pixel tracking events.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may suspend or terminate service for maintenance, updates, or other operational reasons without prior notice.

Limitation of Liability

To the maximum extent permitted by applicable law, HireSpark and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, loss of goodwill, or failure to secure employment — resulting from your use of the service or any AI-generated content, even if HireSpark has been advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount you paid to HireSpark in the 3 months preceding the claim.

Termination

We may terminate or suspend your account and access to the service at our sole discretion, without prior notice, for any reason including breach of these Terms. You may close your account at any time by contacting hello@usehirespark.com.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email. The "Last updated" date at the top of this page indicates the most recent revision. Continued use of the service after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws applicable to HireSpark's place of operation, without regard to conflict of law principles.
